1) Acceptance of These Terms

By accessing the Site, submitting a form, or using any services offered by Padgett Homes (collectively, the “Services”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.

2) Scope of Services (Nationwide)

We operate nationwide in the United States, purchasing residential property where permitted by law. We may complete transactions through local title/escrow companies, attorneys, assignees, or affiliates solely to comply with state/local requirements. Availability may vary by jurisdiction.

3) Our Role (Principals; Not Your Advisor/Broker)

  • We are real-estate principals/investors and may make cash offers to purchase property.

  • We are not your attorney, accountant, financial advisor, fiduciary, or broker/agent (unless explicitly stated in writing and properly licensed where required).

  • We may market properties we own or equitable interests and may assign purchase agreements where lawful.

4) Eligibility & Your Responsibilities

You must be at least 18 and able to form a binding contract. You represent that information you provide is accurate and that you have authority to provide it. You are responsible for complying with all applicable federal, state, and local laws.

5) Offers, Estimates, and No Guarantees

Any offer, estimate, valuation, repair cost, timeline, or closing date is non-binding and subject to inspection, due diligence, title review, market conditions, third-party approvals, and compliance checks. We may decline to proceed at our discretion.

6) User Submissions

If you submit property details or other content, you grant us a non-exclusive, worldwide, royalty-free license to use that information to evaluate and conduct transactions, consistent with our Privacy Policy. You represent you have rights to submit the information and that it does not infringe others’ rights.

7) Prohibited Uses

You agree not to: (a) misuse the Site; (b) interfere with security or functionality; (c) submit false, misleading, or unlawful information; (d) copy, scrape, or reverse-engineer the Site; or (e) violate any law or third-party right.

8) Intellectual Property

The Site, content, logos, and trademarks are owned by us or our licensors and protected by law. You may not use them without prior written consent.

9) Third-Party Links & Services

The Site may link to third-party websites or tools. We are not responsible for their content or policies. Your use of third-party services is at your own risk and subject to their terms.

10) Communications Consent (Email, Voice, SMS)

By providing contact information, you consent to receive service communications (calls, emails, texts) from us and our processors acting on our behalf. Consent is not a condition of purchase or sale. Message/data rates may apply.

These Mobile Terms govern your participation in our text message program and are designed to meet carrier/A2P expectations.

  • Program Description: Updates about cash offers, appointment scheduling, and property-related communications.

  • Opt-In & Consent: You opt in when you submit your number via our forms or otherwise expressly consent. Consent is voluntary and not a condition of any purchase or sale.

  • Message Frequency: Recurring messages; frequency varies based on your interactions.

  • Message/Data Rates: May apply.

  • Opt-Out: Reply STOP to end; HELP for help. We also honor STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.

  • Carriers: Carriers are not liable for delayed or undelivered messages. Delivery may vary by carrier and location.

  • Privacy & Sharing: We do not sell or share SMS opt-in data with third parties or affiliates for their independent use, unless required by law or in connection with a legal obligation. We may use service providers (processors) under contract to deliver messages on our behalf per our Privacy Policy.

We comply with federal, state, and local fair housing laws nationwide and do not discriminate on any protected basis.

13) Disclaimers (No Professional Advice)

All content is for general informational purposes only and provided “AS IS.” Obtain independent legal, tax, or financial advice before entering any transaction. We do not warrant uninterrupted or error-free operation of the Site.

14) Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility. Our total liability for claims arising out of or relating to the Site or these Terms shall not exceed $100 or the amount you paid us (if any) in the 12 months before the claim arose, whichever is greater.

15) Indemnification

You agree to defend, indemnify, and hold harmless Padgett Homes and our officers, directors, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.

16) Dispute Resolution; Arbitration; Class-Action Waiver

  • Informal Resolution. Before filing a claim, email [email protected] with a description and your contact info; we’ll try to resolve within 30 days.

  • Arbitration. Except for matters eligible for small-claims court, disputes arising out of or related to these Terms or the Site will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association (AAA) or another mutually agreed administrator.

  • Class/Jury Waiver. No class or representative actions; both parties waive a jury trial.

  • Opt-Out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with subject “Arbitration Opt-Out,” your name, and the email/phone used on the Site.

17) Governing Law; Venue (Nationwide)

These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules; the arbitration clause is governed by the Federal Arbitration Act. For any non-arbitrable matter, exclusive venue lies in the state or federal courts in Dallas County, Texas. Non-waivable consumer protections in your state still apply.

18) Changes to the Site or Terms

We may modify the Site or these Terms at any time. Changes are effective when posted with an updated Effective Date. Your continued use after changes constitutes acceptance.

19) Termination

We may suspend or terminate access to the Site at any time, with or without notice, for any reason. Sections that by nature survive (e.g., IP, disclaimers, limitations, arbitration) will survive termination.

20) Entire Agreement

These Terms, together with our Privacy Policy and any signed transaction documents (e.g., purchase and sale agreements, assignments), constitute the entire agreement regarding the Site and Services.
